Article 1 - Definitions

 

The following defined terms are used in these General Terms and Conditions:

 

1. general terms and conditions: these general terms and conditions.

 

2. user: the entrepreneur who uses these general terms and conditions in the context of the conclusion and execution of this contract with a customer.

 

3. customer: the person who concludes or has concluded a contract with the user.

 

4. consumer: any natural person who acts for purposes that cannot be attributed to their commercial or professional activity.

 

5. service: a service or the service offered on the user's website (Evignette.co.uk).

 

6. costs for services: The amount payable by the customer to the user (including VAT) for a service to be provided by the user in favour of the customer.

 

7. agreement: the agreement for the purchase of a digital motorway vignette for Austria with immediate validity by the customer. The customer hereby receives a digital motorway vignette, which gives him immediate access to the Austrian motorway network and is delivered to him digitally.

 

8) Asfinag: This is the common name for the Austrian motorway and motorway financing company, Asfinag, which is responsible, among other things, for levying and collecting tolls for the use of certain roads in Austria.

 

9. vignette: This is the name for a document issued by Asfinag in digital form ("digital vignette") or as a sticker ("vignette") and serves as proof of payment of the toll for a specific authorised vehicle for a specific period of time.

 

10. grace period: the statutory period within which the consumer can exercise his right of cancellation.

 

11. cancellation: the exercise of the legal right to cancel a distance contract in writing within the cooling-off period. The model cancellation form has been included as Appendix I to the General Terms and Conditions.

 

Day 12: Calendar day.

 

13. privacy policy: the privacy policy of the user (Evignette.co.uk), which is published on the user's website;

Article 3 - Applicability

 

  1. These General Terms and Conditions apply to every offer made by the user and to every contract concluded between the user and the customer.

 

  1. The text of these General Terms and Conditions will be made available to the customer prior to the conclusion of the agreement in such a way that the customer can save it on a durable medium without any further intermediate steps. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract where the general terms and conditions can be viewed electronically and that they will be sent electronically or otherwise free of charge at the customer's request.

 

  1. The following general terms and conditions apply to all legal transactions between Maut & Vignette B.V. and its customers. The general terms and conditions also apply to consumers, as described in the Dutch Civil Code. 6 Article 230g: any natural person acting for purposes that cannot be attributed to his trade, business or profession.

 

 

Article 4 - The agreement

 

  1. The agreement is concluded upon acceptance of the offer by the customer and fulfilment of the conditions set out therein.

 

  1. If the customer has accepted the offer by electronic means, the user shall immediately confirm receipt of the acceptance of the offer by electronic means. If the contract is concluded electronically, the user shall take appropriate technical and organisational measures to secure electronic data transmission and ensure a secure web environment. With regard to the electronic payment option offered, the user shall observe appropriate security measures.

 

  1. At the latest upon delivery of the service, the user shall provide the customer with the following information in writing or in such a way that the customer can store it in an accessible manner on a durable medium:
  • the address of the user's branch to which the customer can address questions, requests or complaints;
  • the conditions under which the consumer can make use of his right of cancellation;
  • information about any guarantees and the existing service after delivery of the service;
  • the price, including all taxes, for the service; the delivery costs, if applicable; and the method of payment, delivery or fulfilment of the contract;
  • The sample cancellation form for the consumer.

 

 

Article 5 - Right of withdrawal of the consumer

 

  1. The customer can cancel the contract within a period of 14 days without giving reasons.

 

  1. The cooling-off period referred to in paragraph 1 shall commence on the day following the conclusion of the agreement.

 

 

 

Article 6 - Exercise of the right of withdrawal by the consumer

 

  1. If the customer makes use of his right of cancellation, he must inform the user of this within the cancellation period using the sample cancellation form or in another clear manner.

 

  1. The risk and burden of proof for the correct and timely exercise of the right of cancellation lies with the customer.

 

  1. If necessary, the customer shall return the goods received to the user in accordance with the user's reasonable instructions. The customer shall not bear any direct costs for this.

 

  1. If the customer cancels after having expressly requested that the fulfilment of the agreement commence during the cooling-off period, the customer shall owe the user the amount that is in proportion to the part of the obligation that the user has fulfilled at the time of cancellation compared to the full fulfilment of the obligation.

 

  1. The customer shall not bear any costs for the execution of the contract if:
  • the user has not provided the customer with the legally required information about the right of cancellation, the reimbursement of costs in the event of cancellation or the model cancellation form, or;
  • the customer has not expressly requested the start of fulfilment of the contract during the cooling-off period.

 

 

Article 7 - Obligations of the user in the event of cancellation by the consumer

 

  1. If the user allows the customer to declare the cancellation electronically, he must immediately send a confirmation of receipt for this declaration.

 

  1. The user must refund all payments received from the customer, including delivery costs, immediately and at the latest within fourteen days of the day on which the customer notifies him of the cancellation of this contract.

 

  1. The user must use the same means of payment that the consumer used for the refund, unless the consumer has agreed on a different method. The refund shall be free of charge.

 

 

Article 8 - Exclusion of the right of withdrawal for the consumer

 

The right of cancellation is excluded if the user has clearly stated this in the offer or at least in good time before conclusion of the contract:

 

  1. After complete fulfilment of the agreement, but only if:
  • execution has commenced with the express prior consent of the client; and
  • the customer has declared that he waives his right of cancellation as soon as the user has fully executed the contract;

 

Article 9 - Prices

1. the prices stated in the offer of the service consist of the toll costs of Asfinag https://shop.asfinag.at/de/ and the service costs of the user (https://Evignette.co.uk/vignette-osterreich/) for the immediate availability of the vignette.

2. the prices stated in the offer for a service include VAT.

 

Article 10 - Fulfilment of the agreement

 

The user guarantees that the obligations to be fulfilled by him are in accordance with the agreement and the specifications stated in the offer.

 

 

Article 11 - Delivery and execution

 

  1. The user is obliged to fulfil the contract with the greatest possible care.

 

  1. The place of fulfilment is the address provided to the user by the customer.

 

 

  1. The user is obliged to sign the contract within the previously specified deadline and, if this deadline is not met, to sign it immediately.

 

 

Article 12 - Payment

 

  1. Unless otherwise specified in the contract, the amounts owed by the customer must be paid immediately upon conclusion of the contract.

 

  1. The customer is obliged to inform the user immediately of any inaccuracies in the payment data transmitted or provided.

 

 

Article 13 - Complaints procedure

 

  1. The user must have a sufficiently publicised complaints procedure and process the complaint in accordance with this complaints procedure.

 

  1. Complaints about the fulfilment of the contract must be reported to the user in full and clearly described within a reasonable period after the customer discovers the defects.

 

  1. Complaints submitted to the User will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the User shall respond within the 14-day period with an acknowledgement of receipt and an indication of when the customer can expect a more detailed response.

 

 

Article 14 - Applicable law

 

The agreements between the user and the customer to which these terms and conditions apply are governed by Dutch law. If the consumer is established in an EU country other than the Netherlands and the legislation of that EU country offers him better protection, the user will apply these rights.

 

The purchase of a digital vignette with immediate validity for Austria by the customer

1. in order to enable the purchase of a Digital Vignette with immediate validity (or on a date chosen by the customer within 18 days of ordering), the customer concludes a contract with the user. The user's General Terms and Conditions apply to this contract and its conclusion. The terms are also defined in the General Terms and Conditions.

 

2. the customer must follow the electronic order form provided by the user for this purpose on this website step by step in order to purchase the Digital Vignette. Once completed, the customer must use the designated electronic transmission of the completed order form to finalise the order.

 

3. the customer chooses the type of digital vignette and the period of validity of the digital vignette they wish to purchase. As a consumer, the customer has the option of opting for a vignette with an immediate validity period - or a validity start date within 18 days of ordering.

4. the customer acknowledges the toll charges of ASFINAG (https://shop.asfinag.at/de/) and the service charges of the user (https://Evignette.co.uk/vignette-osterreich/).

 

5. the customer must enter the mandatory information (e.g. name, city and postcode, address, telephone number, email address and vehicle registration number) correctly in the electronic order form. Finally, the customer has the option of automatically requesting a VAT invoice.

 

5.1 Before he/she completes the order, the customer receives an overview of the type of vignette, the country of registration of the vehicle, the licence plate number, the validity of the vignette and the total price for the digital vignette with immediate validity or with the desired start of validity, which must be within 18 days of the order.

 

5.2 The customer has the option of paying by Sofort, credit card, PayPal, Giropay and EPS.

 

 

5.3 The customer must expressly state that he has read the General Terms and Conditions, the data protection provisions, the information on cancellation and data processing and that he agrees to electronic delivery and invoicing by e-mail.

 

 

 

5.4 The customer must click on "Proceed to checkout" to finalise the order by paying the user's designated payment provider Mollie.

 

 

5.5 After completion of the order process described above and receipt of payment for the ordered digital vignette including the service fee, the user shall immediately register the digital vignette for the customer electronically with Asfinag, the issuing authority, with immediate validity or on the date requested by the customer within 18 days of the order. The customer receives the digital vignette within a few minutes after payment.

6. by transmitting the digital vignette to the customer electronically, the user has fulfilled his obligation to the customer.
